  • SUPPLEMENTATION AND AMENDMENT OF CERTIFICATES

  • 1. SUPPLEMENTING A BIRTH, MARRIAGE, OR DEATH CERTIFICATE

     

    In accordance with the article 37 of the Civil Status Act of 28th November 2014, civil status certificate which does not include all the data, which are ought to be included (for example: maiden name of mother), requires supplementation.

     

    REQUIRED DOCUMENTS

     

    •             Application to supplement civil status certificate (for supplementing marriage certificate SEE.FORMS TO PRINT.ATTACHMENT 10)

    •             Copy of civil status certificate, which requires supplementation;

    •             Previous civil status certificates, which include missing data (e.g.: the basis for supplementing birth certificate can be parent’s marriage certificate; in case of marriage certificate, the basis can be the birth certificates of spouses);

    •             A document certifying Polish citizenship (a valid Polish passport OR a presidential act granting Polish citizenship OR a document of ascertainment of Polish citizenship OR a decision act of reinstatement of Polish citizenship);

    •             Polish or foreign passport.

     

    The application has to be addressed to the Civil Registry in which a civil status certificate requiring supplementation has been issued.

     

    2. AMENDING A POLISH CIVIL STATUS CERTIFICATE

     

    If a certificate contains obvious orthographic mistakes, the act requires an amendment.

     

    REQUIRED DOCUMENTS

     

    •             Application to amend civil status certificate;

    •             Copy of civil status certificate, which requires amendment;

    •             Previous civil status certificates, which include missing data (e.g.: the basis for amending birth certificate can be one of baby’s parents’ marriage certificate; in case of marriage certificate, the basis can be the birth certificates of spouses, a d). If these acts were issued by a Polish registrar, it is sufficient to name the appropriate registrar and provide information which will help in finding the certificate;

    •             A document certifying Polish citizenship (a valid Polish passport OR a presidential act granting Polish citizenship OR a document of ascertainment of Polish citizenship OR a decision act of reinstatement of Polish citizenship);

    •             Polish or foreign passport.

     

    The application has to be addressed to the Civil Registry in which a civil status certificate requiring amendment has been issued.

     

    A decision to refuse to supplement or amend the certificate is taken by the administrative bodies, which can be appealed at Province Governor’s office. If the amendment is exceeding beyond the correction of the orthographic mistakes, the applicant can file a lawsuit after exhausting all the channels of administrative appeal.
